THIS IS A WAIVER AND RELEASE OF LIABILITY- READ BEFORE AGREEING
I agree to rent the boats and equipment described below for the time period and rate outlined below.  I acknowledge receipt of the Rules and Regulations applying to the boating activities and confirm that I have read them. The Rules & Regulations are included in this agreement and can also be found posted on the company website. In consideration of being provided with this watercraft and equipment, I agree to the following GENERAL RELEASE:

For myself and for my heirs, personal representatives and assigns, I hereby:

  • ACKNOWLEDGEMENT OF RISKS

Acknowledge that some, but not all, of the risks of participating in watercraft activities include:

  • Changing water flow, currents, wave action and wakes from other boats
  • Falling while launching watercraft
  • Collisions with any of the following: other participants, the watercraft, other watercraft, and manmade or natural objects
  • Wind, inclement weather, lightning, variances and extremes of wind, weather and temperature
  • My sense of balance, physical coordination, ability to operate equipment, swim and/or follow directions
  • Collision, capsizing, sinking or other hazard which results in wetness, injury, exposure to the element, hypothermia, and/or drowning
  • The presence of insects, marine life forms, and other wildlife, including alligators
  • Equipment failure or operator error
  • Heat or sun related injuries or illnesses, including sunburn, sunstroke or dehydration, and
  • Fatigue, chill and/or dizziness, which may diminish my reaction time and increase the risk of an accident.
  • EXPRESS ASSUMPTIONS OF RISK & RESPONSIBILITY

Agree to assume responsibility for all the risk of the activity, whether identified above or not. My participation in the rental and activity is purely voluntary. I assume full responsibility for myself for any bodily injury, accident, illness, paralysis, death, loss of personal property and expenses thereof as a result of any accident that may occur while I participate in the activity/rental.

  • RELEASE

Release Kayaking Chuck’s World. Chuck’s World LLC, their principals, directors, officers, agents, employees and volunteers, and their insurers, from any and all claims, demands, actions, causes of action, suits in equity of whatever kind or nature, and from any and all liability of any nature for any and all injury or damage (including death) to me and other persons as a result of my participation in the activity, regardless of the cause. I understand that this release includes any claims based on negligence, action, or inaction of any of the above parties.

ESSENTIAL ELIGIBILITY CRITERIA AND RULES & REGULATIONS

ESSENTIAL ELIGIBILITY CRITERIA

In order to rent the equipment, one:

  • Must have a valid driver’s license as well as proper vehicle insurance on the vehicle that will be used to tow the trailer/equipment as per State and Insurance regulations for the state the rental will take place.
  • Must not exceed the manufacturer’s limit for the vessels which is the combined weight of all participants in the boating party with gear as follows: Kayaks- 275 lbs.
  • Must have the ability to wear a properly fitted personal flotation device
  • Must have the ability to enter and exit the kayak independently or with the assistance of a companion
  • Must have the ability to remain seated, maneuver, and balance independently or with the assistance of a companion
  • Must have one person in the party who is able to move the kayak(s) through the water in a stable manner and return it back to the launching area and trailer
  • Must have the ability to get out from under the watercraft, independently and be able to right oneself and remain face up in the water with the aid of a personal flotation device, in the event of a capsize.

RULES & REGULATIONS

  • Boat rentals are at your own risk. Kayaking Chuck’s World & Chuck’s World LLC are not responsible for personal injury or loss of property. Participation in boating activities may be dangerous. Management reserves the right to deny rental.
  • Person renting boat must be 18 years or older. Parent or legal guardian required to allow minor participation.
  • Maximum capacity- Kayaks are for one (1) person per kayak.
  • Florida law requires children 6 years of age and under must wear a personal flotation device (PFD). All other occupants must have PFD in their possession. Provided whistles must be aboard kayaks.
  • Wearing life vests at all times help reduce the risk of drowning.
  • Alligators can be dangerous! Avoid close encounters with alligators. Do not feed wildlife. Please note some marine life is protected by law (i.e. manatees).
  • You are required to abode by all rules of State and Local beaches, reservoirs, lakes and/or rivers.
  • These kayaks are to be used ONLY for Class 1 flat water including rivers, lakes, and streams. They are NOT be used in the ocean or white water as they are not intended for this use. 
  • To Avoid Capsize:
    • Do not stand up in boat
    • Stay in the middle of the boat
    • Keep a low center of gravity

If you do capsize- turn kayak so it is floating in the water correctly and climb back into the kayak. If you can’t get back into the kayak, climb or hang onto the end of kayak and paddle/kick to shore and have someone assist you in getting back into the kayak.

  • Alcoholic beverages, drugs and pets are prohibited.
  • No gas or electric motors are to be attached to rental boats.
  • Do not stay on the water in the event of thunder and/or lightening.
  • Please make sure you have plenty of water, bug spray, and sunscreen on all trips.
  • If your boat capsizes, it will continue to float. Hold on to the boat as you make your way to shore.
  • Please dispose of liter in trash cans at end of all trips.
  • Be very alert to all boat traffic, especially motorized traffic, and follow the basic rules of all nautical roads. Boats may often not see kayaks as they sit so low in the water.
  • Renter will be required to reimburse Kayaking Chuck’s World for all damaged or lost equipment. Reimbursement will be at replacement cost and will be charged to your credit card used to reserve rental date. The replacement value is: $2300 per trailer, $500 per kayak, $35 per paddle, $20 per life jacket.
  • Upon returning boats to trailer, turn them upside down to allow them to drain/dry. Upon returning trailer to original location, put lock in trailer hitch.
  • All boats and equipment must be returned at agreed time as outlined in contract. Additional charges equal to a full weekend rental will be assessed for equipment not returned at designated date/time.
  • Be careful when launching boat at a boat ramp as the ramp may be very slippery.
  • REFUND POLICY: In the event that you need to cancel or change the date of your reservation, please contact Kayaking Chuck’s World, via phone or email, within 24 hours of your scheduled reservation to receive a either (1) a full refund or (2) rain check. All rain checks can be used as credit towards a future reservation(s).
  • Reservation Guarantee: Upon receipt of all completed and required documentation as well as full payment for reservation, Kayaking Chuck’s World will guarantee your reservation. Should you not receive the equipment on the agreed upon date/time, Kayaking Chuck’s World will either refund you the full amount of your rental or (2) issue you a rain check to be used a credit towards a future rental. Your rental is not considered guaranteed until Kayaking Chuck’s World provides you with a copy of your payment receipt showing proof of payment received as well as all required documentation.

 

RENTAL INFORMATION

All rentals include the (insert dimensions) trailer, 4 kayaks, 4 lifejackets with whistles, & 4 double sided paddles

Rental Must be Returned No Later than 11:59pm on your specified return date or you will be charged a full weekend day rental equal to $49.99 to your credit card on file to hold reservation.

The acceptance of the adult individual who will be renting and using the watercraft/equipment is required below. I HAVE READ THIS RELEASE OF LIABILITY AND ASSUMPTION OF RISK AGREEMENT, FULLY UNDERSTAND ITS TERMS, UNDERSTAND THAT I HAVE GIVEN UP SUBSTANTIAL RIGHTS BY AGREEING, AND AGREE FREELY AND VOLUNTARILY WITH OUT ANY INDUCEMENT. By selecting the “I have read and agree to Terms & Conditions and Liability Agreement” button  and typing your name below, you are signing this Agreement electronically. You agree your electronic signature is the legal equivalent of your manual signature on this Rental Agreement. By selecting “I have read and agree to Terms & Conditions and Liability Agreement” you consent to be legally bound by this Agreement’s terms and conditions.
